5. The is elected by the people' at the same Hine for the eame term, end noust possees the same qualificatione, as the governor. He is presideat of the senate by virtue of his office, and has the casting vote. Io ease of the incapacity of the governor, hie death, removal from office, resignatioa, or abeence from the state, refusal or friability to qualify, he is to act as governor.

The Secretary of State is elected by the people for the term of four yeare.

The Treasurer is elected by the people for the term of two years.

The Judicial Power.

The Supreme Court consists of a chief-justice, elected by the people of the state at large for the ,iterm of ten years, and four associatejustices, elected, one in each of the four districts into which the state is divided, for the term of eight yeare. The associate justices are so classified that one goee out of office every two years. It has appellate juris diction of all civil cases where the amount in die pnte is more than three hundred dollars, or where the constitutiouality of amy duty, tax, or impost, or any fine, penalty, or forfeiture imposed by a municipal court, is brought in question ; and in criminal cases where the punishment is death, im prieonment at hard labor, or a fine exceeding three hundred dollars. Its civil remedial jurisdiction extends both to law and fact, and it inny reveree the verdict of a jury, and render a final decree in oppoeition to the fiuding of the jury. In criminal cases it corrects errors of law only. It has only an appellate juriediction, but may issue the writ of habeas corpus. It holds one term annually in each district.

6. 2'he District Court is composed of one judge elected in each uf the eighteen districts (except the first) into which the state is divided for the pur pose, by the people of the dietrict, for the term of four years. The city and parish of New Orleane constitutes the first district, but has eix judges. It has jurisdiction of all civil cases what ever in which the amount involved ie over fifty dollars,)n all criminal caaes, and in all matters of successions. Jury and probate jerms are held eeparately. The districte are never to be leee than twelve nor more than twenty io number, uod sub ject to reorganization every sixth year.

Justices of the Peace are elected one or more from each police-jury ward, into which the several parishes of the etate are divided, for the term of two years. They have civil juriediction where the nmount in dispute does not exceed one hundred dollars, and where the defendent resides within their section. They may perform marriages; take cognizance of infractions of the levee lawe, where the penalty is not over one hundred dollars; may disperee runaway gloves, search for stolen geode, and arreet slaves suspected of any crime whatever; take cognizance of proceedings under the landlord and tenant process.

Jurisprudence.

This state is the only one of the United States in which the civil law, in contradistinction to the common law of England, prevails. The code of Louisiana is fouoded on the Code Napoleon, with some modifications introduced from Spanish law, and, through theee, upon the Romeo law. See CODE.
