Circuit Courts are held in every county in the state, by one or more justices of the supreme court, or a judge appointed for the purpose For this purpoee the state is divided into seven distr:cts, and one — judge assigned to each district. In all cases within the °aunty, except in those of a criminal nature, these courts nave common-law jurisdiction ooncur rent with the supreme oourta; and any final judg ment of a circuit court may be docketed in the su preme court, and operatea as a judgment obtained io the supreme court from the time of such dooket ing. Final judgments ill any circuit oourt may ba removed by writ of error into the aupreme court, or directly into tha court of errors and appeals; and q uestions of law which arise are to be certified by the praeiding judge to the aupreme court for deciaion.
11. Common, Pleas Coati t. This in each county is oomposed of five judges, appointed for five years by senate and general aasembly by joint ballot. One goes out of office eaoh year.
Oyer and Terminer and General Jail Delivery.
This court is held by one or mure justices of the supreme court, and one or more of the court of oommon plaa,a, ic eaoh county, at the times of hold ing the circuit court, and ouch other times as the judge of the supreme court may s,ppoint. It haa oognizance of all crimes whatever of an indictable or presentable nature committed in the county where tha court is bald.
Court of Quarter Se88i0218. This court is compoaed of three or more justices of the court of mammon pleaa in each county. It has cognizance of all crimes fur purpoaas of indictment; but all capital erimas and those of the gravercharacter must ba tried by the court of oyer and terminer or supreme oourt. The Orphans' Court is held in each county, hy three or more judges of tha oommon plena court. It has the original jurisdiction of the probate of wills, set tlement of the astates of decedents, appointment and control of adminiatrators and executors, end the care of minora, including the appointment and oontrol of guardiana. Four terma of this court are held an oually. An appeal lies to the prerogative oourt, bald by tha chancellor. Tha duties of clerk or register of this court are discharged hy a aurro gato,elected by the people of tha county for five years.
Justices of the Peacs are elected by the people of each township, or ward of city, not less than two nor more than fiva for each such division, for five years. They have oognizance within their countiea of civil mattera to an amount not exceeding ooe hun dred dollars, except those cases involving lan d-titlea, and actions of replevin, slander, or trespass for as sault and battery or imprisonment. A jury of aix must be impanelled on demand of either party.
